Welcome to Honolulu Jewelry Company. These Terms & Conditions (“Terms”) govern your access to and use of honolulujewelrycompany.com (the “Site”) and any purchase you make from us. The Site is operated by Honolulu Jewelry Company, a unit of Johnson Pacific Enterprise, Inc. (“Honolulu Jewelry Company,” “we,” “us,” or “our”).

By accessing the Site, placing an order, or checking the box indicating you have read and agree to these Terms at checkout, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

1. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. If you create an account, you are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us promptly of any unauthorized use.

2. Products, Descriptions & Availability

Our jewelry is handcrafted, and many pieces are made to order, customized, personalized, or engraved. We work to describe and display our products as accurately as possible; however, we do not warrant that product descriptions, weights, measurements, or other content are complete or error-free. Because each piece is handmade and because screens display color differently, the actual color, finish, and appearance of an item may vary slightly from the images on the Site. All products are subject to availability, and we may limit or discontinue any product at any time.

3. Pricing & Payment

All prices are listed in U.S. dollars (USD) and are exclusive of applicable taxes unless stated otherwise. We accept major credit cards (Visa, Mastercard, American Express, and Discover), processed securely through our third-party payment processor. We do not accept PayPal.

We strive to ensure pricing is accurate, but errors may occur. If we discover a pricing error on an item you have ordered, we reserve the right to cancel the order and notify you, whether or not the order has been confirmed or your payment charged; in that event we will issue a full refund.

Applicable Hawaii General Excise Tax and any other required taxes are calculated and added at checkout based on your delivery address.

4. Order Acceptance

Your order is an offer to purchase. Our acknowledgment or order-confirmation email confirms that we have received your order; it does not constitute acceptance. We reserve the right to accept or decline any order, or to limit or cancel quantities, for any reason, including suspected fraud, errors in pricing or product information, or insufficient stock. If we cancel an order after you have been charged, we will issue a full refund.

5. Shipping & Delivery

Shipping options, costs, and estimated delivery times are described on our Shipping & Returns page, which is incorporated into these Terms. Delivery time estimates are not guaranteed. Risk of loss for physical goods passes to you upon our delivery of the items to the carrier. For international orders, you are the importer of record and are responsible for any customs duties, taxes, or fees imposed by the destination country.

6. Returns & Refunds

Returns, exchanges, and refunds are governed by our Shipping & Returns page, which is incorporated into these Terms. In summary: eligible merchandise in sellable condition may be returned within 30 days of purchase, less any applicable shipping fees. All sales are final on special orders, personalized items, and engraved merchandise. For custom, personalized, or engraved pieces, you are responsible for confirming the accuracy of all specifications (including spelling, sizing, and metal/stone selections) at the time of order.

7. Warranty

Our products are covered by the lifetime warranty described on our Shipping & Returns page: a lifetime warranty against defects in materials and workmanship. This warranty does not cover normal wear and tear, accidental damage, misuse, loss, theft, or unauthorized repairs or modifications. Except for that express warranty, and to the fullest extent permitted by law, all products are provided without any other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

8. Acceptable Use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt unauthorized access to any systems or accounts, to submit false or fraudulent information, or to infringe the rights of others. We may suspend or terminate access to the Site for any violation of these Terms.

9. Intellectual Property

All content on the Site — including text, graphics, logos, product photographs, designs, and the “Honolulu Jewelry Company” name and marks — is the property of Honolulu Jewelry Company / Johnson Pacific Enterprise, Inc. or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Honolulu Jewelry Company and Johnson Pacific Enterprise, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any product purchased. Our total liability for any claim arising out of or relating to these Terms or a purchase will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Honolulu Jewelry Company and Johnson Pacific Enterprise, Inc. and their officers, employees, and agents from any claims, damages, or expenses arising out of your violation of these Terms or your misuse of the Site.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. The “Last updated” date above reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Hawaii, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or a purchase will be brought exclusively in the state or federal courts located in Honolulu, Hawaii, and you consent to their jurisdiction.
